SC: HC to hear Colaba jetty plea expeditiously, stay ‘uninfluenced’

Mumbai: Supreme Court on Thursday said the plea against construction of a passenger jetty at Colaba should be heard by Bombay HC expeditiously, and granted no relief to another set of petitioners challenging the lack of relief from HC. It said HC would pass orders uninfluenced by its comments in another case that was dismissed this week.While hearing a petition by Clean and Heritage Colaba Residents Association against HC’s May 7 order, SC said all issues, including the piling aspect, can be argued before HC. It noted that as it had already heard and decided the plea filed by Laura Dsouza and other residents who had challenged the HC order declining to stay the jetty construction, no separate orders were needed to be passed and the ambit of argument was restricted.The HC bench of Chief Justice Alok Aradhe and Justice M S Karnik, in its order to the two petitioners, had said the construction work would be subject to the outcome of the petitions filed against the project. While denying relief to the association through its vice president, Pervez Cooper, who challenged the same jetty work, it said no objection was raised until the awarding of the work order for the jetty’s construction, and the petition was filed on the eve of commencement of the work.HC said it was not possible at this stage to state that there is overwhelming public interest in granting a stay “while weighing conflicting public interest”. “The public interest involved, the balance of convenience, and the financial impact if the project is stayed are the factors which have to be borne in mind while granting or refusing the interim relief.”
