RR collector faces contempt case for selective adoption of HC orders

Hyderabad: Ruling that then Nalgonda collector C Narayana Reddyresorted to selective adoption of judgments that suited his thinking while implementing a court order, Justice T Madhavi Devi of Telangana high court issued a suo motu contempt notice to him.The IAS officer, now in Rangareddy, is facing this case for his previous action as district collector of Nalgonda.The case pertains to extending the benefit of minimum time scale of pay and annual grade increments to daily wage/ad-hoc workers in the rural development wing. The high court had earlier referred to the judgments cited by the workers’ counsel and directed the district collector to take a decision in tune with the essence of the orders. As arrears have to be paid from 1997, the collector rejected the applications of the workers. He said that the cited judgments would help the regular employees and not the ad-hoc ones. However, he failed to refer to the other cited judgments that made it mandatory for fixing a minimum pay scale even for the ad-hoc workers. Wondering whether this is a selective approach adopted by the collector determined to do what he intends to do, Justice Madhavi Devi issued contempt notice to the RR district collector for his Nalgonda action. The judge, while hearing the contempt plea of the workers, noted that it was essential to take the bureaucrat, who misinterpreted the judgment, to task rather than asking the current collector to explain the reasons for the folly.The judge, on her own, brought in Narayan Reddy as one of the respondents to the contempt plea and issued notice to him.The judge, however, gave him a benefit of doubt. He might have failed to understand the essence of the HC order. Hence he was given four weeks time to comply with the order of the court or face contempt proceedings later.
