High court lambasts cricket body for violation of rules, nepotism

Patna: Patna high court ruled that due to mismanagement prevailing in the Bihar Cricket Association (BCA), which is affiliated to Board of Cricket Control of India (BCCI), the cricketers as well as the game is suffering in the state.
The court, in order to curb the “brazen violation of rules and regulations” and nepotism by the office earers of the BCA, appointed Retd Justice of Patna HC Shailesh Kumar Sinha as ombudsman to take action against the illegal activities of the office bearers.
A single bench of Justice Sandeep Kumar while disposing of a writ petition of secretary of Cricket Association of Bihar (CAB), Aditya Prakash Verma, also ordered the association to appoint a fresh selection committee which can select the genuine and deserving cricketers to represent the state in domestic tournaments of the country.
The judgment was uploaded on the high court’s website late evening of Tuesday.
In his 54-page verdict, Justice Kumar remarked, “In the opinion of this court, the BCA is meant for advancement of cricket in the state, but due to maladministration prevailing in it, the game of cricket has been suffering since long. Substandard selectors are appointed who select meritless players which results in giving bad names to the state.”
Verma had filed this case for disaffiliation of the BCA from BCCI, on account of corruption and mismanagement prevailing therein. He had also prayed for the high court’s direction to the BCCI to initiate inquiry on the several complaints made to it about the wrongdoings of the office bearers of the BCA.
Petitioner’s counsel Abhinav Srivastava informed the court that despite his client’s concerted efforts of raising alarm about the malpractices committed by the violation of rules and regulations framed for the association, the office bearers, including the chairman of BCA, continued to act in an autocratic manner.
The high court found that selectors were appointed illegally, in lieu of which the sons of vice president and joint secretary of BCA were selected. This is a clear cut case of “quid pro quo”, Justice Kumar said, and directed the BCCI to act like an independent body and take prompt notice on the complaints made against the mismanagement in BCA.
