Patna: Patna high court on Tuesday directed for issuance of notices to all eight accused facing trial in banned Ranveer Sena’s chief Brahmeshwar Mukhiya murder case, so that they can file their responses on a plea seeking their trial to be conducted on the chargesheet filed by the Central Bureau of Investigation (CBI).
The eight accused in the case are Ritesh Singh alias Monu Singh, Hulash Pandey, Abhay Pandey, Nand Gopal Pandey alias Fauzi, Amitesh Kumar Pandey, Prince Pandey, Baleshwar Rai and Manoj Rai alias Manoj Pandey.
A single bench of Justice Sandeep Kumar while hearing a petition of son of Mukhiya, Kumar Indu Bhushan, passed this order.
On July 15, Justice Kumar had stayed the trial of Mukhiya’s murder case which was being conducted by a special court for MP/MLA at Ara in Bhojpur district.
Mukhiya was gunned down on June 1, 2012 near his house in Ara. The state govt on June 6, 2012 had recommended a CBI probe into the murder case.
Indu Bhushan has alleged in his petition that the criminal trial initiated by special court in Ara is illegal, as it is based on the chargesheet submitted by the Bihar police, whereas the probe in the case has been conducted by the CBI.
Petitioner’s counsel Madhav Raj submitted in the court that an application was submitted before the special MP/MLA court of Ara to conduct the trial on the chargesheet filed by the CBI, but it was rejected on April 18 this year.
This matter will be heard again after four weeks.
