ORERA fines realtor, orders demolition of 3 unauthorised floors

Bhubaneswar: In a landmark judgment, Odisha Real Estate Regulatory Authority (ORERA) has ordered demolition of three unauthorised floors constructed by a real estate developer in Puri while also imposing a fine of Rs 90 lakh on the builder for violating rules.
According to the case history, a real estate developer had taken plan approval from Puri-Konark Development Authority (PKDA) in 2021 for construction of a seven-storied residential complex in Puri and had obtained the registration number from ORERA.The realtor had later revised its plan and converted the building into a residential-cum-commercial complex and also increased the numer of floors to 10 in contravention to existing rules.
The matter was highlighted by a social activist from Puri following which ORERA took cognizance of the matter. While hearing the case, the ORERA had first show-caused the realtor, which in its reply told the authority that he had taken approval for the revised plan from PKDA for conversion of the building to a mixed use complex with the increase in floor numbers and had submitted documents as well.
While verifying documents, ORERA noticed that the realtor had been asked by PKDA to obtain no-objection certificates from concerned authorities following which the revised plan would be approved. But the same had not obtained. Following this, the authority asked its enforcement officer to make a site visit and file a report on the construction status. The enforcement officer submitted a report mentioning a 10-storied commercial-cum-residential building with 355 units.
ORERA chairman Siddhanta Das said authority took cognizance of the violation and initiated action accordingly. “The violation is serious. It could have impacted homebuyers. Hence action was taken,” Das said. Puri municipality and PKDA enforcement officer Abhimanyu Behera said they will demolish the three floors after receiving the ORERA order.
