Officer punished by government receives relief from High Court | Patna News – Times of India


Patna: Patna high court granted relief to an officer, who was punished by the state government for alleged irregularities that were committed three years after his transfer.
A single bench of Justice Bibek Chaudhuri, while allowing the writ petition of one Tara Nand Mahto Viyogi, quashed the departmental punishment given by the state government to the officer on April 28 last year.
Owing to the punishment, the officer’s increments for two consecutive years were withheld putting in disarray his promotions also.
The judgement was passed on July 20, but its copy was made available on Friday.
Senior counsel Amit Shrivastava while arguing for the petitioner submitted that Viyogi was posted as senior deputy collector and also the incharge district welfare officer (ICDS) at Bhabua in Kaimur district between July 2011 and October 13, 2012.
Amit informed the court that first alleged irregularities in Bhabua shelter home was detected in 2015, which was three years after Viyogi was transferred from Bhabua to Araria. He further argued that since Viyogi was not posted in Bhabua when the alleged irregularities was committed, so he cannot be held accountable.
