Nine teams to inspect illegal bldgs: Thane civic body to HC

Mumbai: Thane Municipal Corporation on Thursday told Bombay High Court it has set up nine teams to undertake zone-wise inspection of illegal constructions and will begin with green and no development zones.Justices Girish Kulkarni and Arif Doctor were hearing a petition by senior citizen Subhadra Takle regarding 17 buildings that were erected by land mafia who had usurped her 5.5 acre property at Shil village. On June 12, HC ordered immediate site inspection by a court officer and a judicial inquiry.Senior advocate Ashutosh Kumbhakoni for TMC said the civic body will implement the HC order in its true letter and spirit and take proactive steps. He briefed the court on the demolition of buildings, including 10 that were completely razed and 5 partially. “When I say demolish it is not the usual demolition, namely removal of the frame of doors and windows,… ground zero,” said Kumbhakoni.He then submitted that the HC order referred to taking action in other areas, and therefore the municipal commissioner formed nine teams headed by an assistant commissioner who will initially concentrate on green and non-development zones. The judges requested that the teams “concentrate on major illegal constructions if they at all come across” in green and no-development zones “so that timely action can also be taken”. They directed such a survey be undertaken and a report be placed before the court.The judges took note of the June 18 compliance report submitted by the court commissioner in respect of 17 buildings. The report confirmed that whatever has been said in the HC order and the petition “is a wholly correct position in regard to this large scale and massive illegal construction”. The buildings had no numbers or identification on the buildings. Apart from 17 buildings, there were other buildings on the said plot. At the time of demolition, significantly no one came forward claiming ownership of the buildings. “This is really interesting. Such a massive construction and nobody comes forward,” said Justice Kulkarni. The judges noted “there were also attempts to put up additional two floors”. “What a colossal waste,” said Justice Kulkarni.The judges in the order said, “We are of the opinion that the proceedings involve very serious issues, with regard to the role of municipal officers, the land mafia which has such audacity to undertake illegal construction and for which certainly an appropriate legal approach is required to be taken.” The court adjourned the hearing to Monday.
