Mumbai: Man accused of raping woman secures bail, judge questions authenticity of 'live-in contract'

MUMBAI: Observing that it was apparently a consensual relationship between two adults which subsequently soured, leading to the complaint, a sessions court last week granted anticipatory bail to a 46-year-old man accused of raping his 30-year-old former live in partner.
While the accused submitted a MOU which showed that the woman and he had entered into contractual live-in-relationship for 11 months from August 2024 to June 2025, the judge said that there was nothing at this stage to ascertain its authenticity.
“The victim has denied her signature on such MOU. The document of MOU placed on record is merely a xerox copy with stamp of Notary. However, it is the part of defence of the accused about nature of relationship between the parties,”additional sessions judge Shanaya V Patil said.
Granting him the relief, however, the judge said that considering the nature of offence and accusations, the accused was required for custodial interrogation.
“The allegations about any obscene videos of complainant (woman) are not specific. Moreover, the accused can be asked to co-operate the investigation on such aspect. Considering the nature of offence and the accusations, the applicant is required to be protected from arrest,” the judge said.
The woman, who was divorced, told the cops that she came in contact with the accused on October 6, 2023. She further said that after they became acquainted, the accused proposed marriage. The woman said that initially she refused to have any physical relationship with him, however, on his promise to marry her, she consented.
The woman said that thereafter she got to know that the accused was involved with another woman. She alleged that despite this he raped her at his residence and threatened her with her compromising videos. The woman alleged she became pregnant, however, the accused gave her some abortion pills.
Thereafter, she also came to know that the accused is staying with his wife. It is alleged that his first marriage is in subsistence and still he committed rape on her repeatedly under promise to marry her. Hence, the complaint was filed on August 23.
Through his lawyer Sunil Pandey, the accused sought pre arrest bail on the grounds that he is falsely implicated. “That the applicant and complainant are in live-in-relationship for last 11 months as per the MOU executed by them. That it is a consensual relation maintained by them and therefore, any offence of rape is not prima-facie made out,” Pandey submitted.
