HC reunites mom with kid ‘forcibly’ taken away by dad

Mumbai: Bombay High Court‘s vacation bench recently reunited a mother (31) and her child (5) after the woman, a Mumbai resident, said her estranged husband took the child away on the night of April 28. He allegedly picked her up and dashed out with her, and the police initially refused to register a complaint, saying the father has equal rights over his child.On April 30, police finally registered an FIR invoking BNS sections against the father and his parents.The mother alleged he took the child “forcefully” and feared he would take the minor abroad, where he worked. She moved HC after she alleged police gave her no update on the whereabouts of her minor daughter. On May 13, HC directed the police to produce the father and child. A vacation bench of Justices Kamal Khata and Arif Doctor, after hearing her lawyer Dushyant Purekar, directed additional public prosecutor Poonam Bhosale to produce both the husband and daughter on May 14 at 10.30am in court. The concerned police officer was present in court too and acted with alacrity. Purekar referred to CCTV camera footage of the building.On May 14, the father brought himself to court along with the child. Both parents agreed the father would be entitled to meet the child every Saturday between 11am and 6pm.
