HC: Release couple as arrest grounds wasn’t notified | Bengaluru News
Bengaluru: Pointing out that the grounds of arrest were not communicated in terms of Supreme Court’s mandate, the Karnataka high court Tuesday ordered the immediate release of businesswoman, Aishwarya Gowda and her husband KN Harish in a cheating case registered by Chandra Layout police.
In his order, vacation judge Hemant Chandanagoudar granted liberty to the police to continue the investigation, search and seizure.”It is made clear that the petitioners shall cooperate with the investigation. In relation to the crime number, they shall not destroy or tamper with evidence,” the judge added.
The couple was arrested on a complaint by Vanitha Aithal, owner of Vaarahi World of Gold in Chandra Layout in the city. It is alleged that Aishwarya Gowda borrowed 14.7 kg of gold from Aithal, but failed to return it. She allegedly claimed to be sister of former Bangalore Rural MP DK Suresh.
The petitioner couple claimed that they appeared before the police for investigation on Dec 28 and thereafter, the investigation officer, without recording the grounds of arrest, took them into custody. The trial court refused interim bail and gave them to eight days of police custody.
