HC orders health secy to appear over ‘encroachment’ in Sishu Bhawan | Bhubaneswar News

Cuttack: Orissa high court has ordered the personal appearance of the secretary of health and family welfare department on Dec 19 in connection with the alleged unauthorised occupation and encroachment at Sardar Vallabhbhai Patel Postgraduate Institute of Paediatrics (Sishu Bhawan) in Cuttack.
The special bench dealing with suo motu PILs on civic issues in Cuttack issued the order on Thursday after taking note of the report of the advocates’ committee on the presence of “substantial encroachments” for which Sishu Bhawan’s northern gate on the Lalbag police station side has practically remained closed.
Expressing dismay, the division bench of Justices Sangam Kumar Sahoo and V Narasingh observed, “This court is shocked and deeply pained perusing the advocates’ committee report. The photographs and video presentation are a testimony to how a premier institute of the state, which is meant for child health care, is being mismanaged by the authority.”
The bench also observed, “It is strange that both sides of the roads of the gates of Sishu Bhawan are encroached. The lackadaisical attitude of the authority cannot be countenanced.”
“The distressing condition in which the premier institute is functioning, as per the advocates’ committee report, needs to be addressed on an emergent basis,” the bench further said, adding, “This court expects that the authorities shall do well to take all necessary measures forthwith to ensure that there is no hindrance in the free movement of the doctors, patients, their attendants, and ambulances through the gates from the Lalbag police station side.”
Accordingly, the bench ordered the secretary, health and family welfare, along with Cuttack collector, DCP (Cuttack) and commissioner of Cuttack Municipal Corporation to remain present “either in person or through video conference to assist this court in addressing this issue” on Dec 19.
The advocates’ committee, headed by president of High Court Bar Association, Bijay Dash, reported that the northern gate has remained closed for the past few years as a number of shops, including small and tea stalls, are operating on the road outside. Waste generated by the unauthorised occupants piled in Sishu Bhawan, leading to unhygienic conditions.
