During the course of hearing, he moved an amendment application requesting the court to add in the election petition that Dhangar belonged to Other Backward Caste (OBC) and he did not belong to the Scheduled Castes (SC). The present Tundla seat is reserved for SC. The petitioner wanted Dhangar’s election to be declared as void. This amendment application was opposed by Dhangar.Dismissing the election petition filed by Prem Pal Singh on May 30, Justice Rohit Ranjan Agarwal observed, “As the petitioner has not disclosed the material facts in his election petition and had tried to subsequently get the election petition amended; therefore, the application moved by Dhangar for dismissing the election petition for non-disclosure of cause of action stands allowed.”The court directed that the substance of this decision be intimated to the Election Commission and the Speaker of the Uttar Pradesh Legislative Assembly. “A certified copy of this decision be sent to the Election Commission of India (ECI) forthwith,” the court added in its judgment.
