HC holds order on actor’s plea against attaching Annai Illam

Chennai: Madras high court on Wednesday reserved its order on a plea moved by actor Prabhu against the attachment of his father Sivaji Ganesan‘s T Nagar house, Annai Illam, in a suit filed for the default of a loan by his brother Ram Kumar and his son Dusshyant Ram Kumar. Concluding the final hearing, Justice Abdul Quddhose reserved the order.
On March 3, the court passed the attachment order on an execution plea moved by Dhanabakkiam Enterprises, seeking to execute a decree ordered in its favour. According to Dhanabakkiam Enterprises, a loan of 3.75 crore was issued to Eshan Productions, represented by Dusshyant and his wife Abirami, for producing a film, ‘Jagajala Killadi’.
As Dusshyant failed to repay the loan as promised, an arbitration proceeding was initiated against him. A decree was issued in favour of Dhanabakkiam Enterprises, granting the right to exploit all the rights in connection with the film “Jagajala Killadi,” including its OTT rights. Additionally, Dusshyant was also ordered to pay 9.39crore, including 30% interest.
Since the film could not be completed, the arbitral decree could not be executed by Dhanabakkiam Enterprises, prompting it to move an execution petition seeking to attach Sivaji’s house, in which Dusshyant’s father, Ram Kumar, holds a share. It wanted the court to execute the arbitral award dated May 4, 2024, passed in favour of the petitioner. The execution petition was filed for the recovery of 9.39 crore, which was due as of the date of the filing of the execution petition and payable to the petitioner by the respondents.
During the course of the hearing, the court was informed that Ram Kumar does not hold any stake in the house and it wholly belongs to Prabhu.
