First FIR under new crime laws in Mumbai: Cheating and impersonation case filed | Mumbai News – Times of India
MUMBAI: The Mumbai police have begun implementing the new crime laws, replacing the British-era criminal laws, in cases registered across the city’s police stations starting from July 1. The first cases under the new laws include three non-cognizable offenses (NC) and a first information report (FIR) related to cheating and impersonation, registered at the DB Marg police station on Monday.The victim, a roadside food stall vendor, was duped of Rs 73,116 after searching the internet for a Rs 5 lakh loan.
Dilip Singh (36), a resident of Girgaum, fell victim to the scam between June 25 and July 1 when he paid the money as processing fees for the loan he sought. The case was registered under the new law Bharatiya Nyaya Sanhita (BNS) 2023 section 318 (4) (cheating), 319 (2) (cheating by personation), and under the IT Act sections 66 (C) (identity theft) and 66 (D) (impersonation using an electronic device) against an unknown person.
Singh was duped after clicking on a link he found on Facebook and entering details to apply for the loan on June 25. “The next day, I received a call from a person claiming to be from a financial institution and was informed that my application for a Rs 5 lakh loan had been approved. He made me transfer money as registration fees, processing charges, GST, etc.,” Singh stated in the FIR.
A DB Marg police officer said Singh became suspicious when he inquired with the caller about not receiving the Rs 5 lakh credit in his bank account despite transferring Rs 73,116. Singh filed the complaint when the caller demanded an additional Rs 30,000.
Joint Commissioner of Police (Law & Order) Satyanarayan Chaudhary confirmed that the city police have started registering cases under the new law. The three NCs are registered in police stations at Airport, Sahar, and Vile Parle, while the first FIR is registered at the DB Marg police station.
The Airport police registered an NC offense under BNS sections 115 (2) (Voluntarily causing hurt), 352 (Intentional insult with intent to provoke a breach of peace), 351 (1) (criminal intimidation), and 3 (5) (When a criminal act is done by several persons in furtherance of the common intention), corresponding to IPC sections 324, 323, 504, 506, and 34, respectively.
Sahar police station registered an NC case under BNS sections 115 (2) (hurt) and 353 (B) (Statements conducing to public mischief), corresponding to IPC sections 323 (hurt) and 504 (intentional insult). Vile Parle police registered a case under BNS sections 352 (intentional insult) and 351 (2) (criminal intimidation), corresponding to IPC sections 504 (insult) and 506 (criminal intimidation).
