Bengaluru: The high court passed a conditional interim order directing police not to take any coercive action against Wing Commander Shiladitya Bose in relation to a criminal case registered against him.
In his order, Justice Hemant Chandanagoudar ordered notice to Byappanahalli police and Vikas Kumar SJ, the complainant in the case.
“Police shall not take any coercive action and shall not summon the petitioner without following due procedure of law. The petitioner (Bose) shall cooperate with the investigation. The chargesheet should not be submitted without leave of this court.” the judge said in his order delivered Thursday.
Bose has challenged the FIR registered under BNS sections 109 (attempt to murder), 115(2) (voluntarily causing hurt), 304 (snatching), 324 (mischief) and 352 (intentional insult) and consequential proceedings pending before a city court.
Bose, posted at Kannur in Kerala, was visiting his wife, a CV Raman Nagar resident in Bengaluru earlier this week. He said that on April 21, he was on his way to Kempegowda International Airport en route to Kolkata where his father was ill and needed to be admitted to hospital. He said Kumar, who was riding a motorcycle, stopped the car by which he and his wife were travelling on Old Madras Road. Bose claimed Kumar attacked him and abused him in Kannada.
As Bose’s claim triggered a row and his wife lodged a complaint, Byappanahalli police tracked down Kumar and arrested him. By then a video clip of the incident surfaced showing Bose thrashing Kumar. Released on bail, Kumar lodged a complaint against Bose, who was booked for attempt to murder. Byappanahalli registered the FIR against Bose and asked IAF to get him to appear before the investigation officer.
