Mumbai: Supreme Court on Tuesday refused to entertain a plea challenging a Bombay high court order which had declined to stay the construction work for a standalone passenger jetty and terminal facilities project between the Gateway of India and Radio Club in Colaba. The Maharashtra Maritime Board (MMB), represented by additional solicitor general Aishwarya Bhati and advocate Ishwar Nankani, said it was a public project and HC had declined to stay the construction. The residents, represented by senior counsel Sanjay Hegde and advocate Anita Castellino, said the project needed to be re-examined and halted for now.The SC bench, comprising Chief Justice B R Gavai and Justice Augustine George Masih, in its order, said, “We are not inclined to entertain the petition since HC has already fixed the matter for hearing on June 16. The special leave petition is, accordingly, dismissed…However, we would request HC to take up the matter and decide it as expeditiously, preferably before this monsoon.” When SC asked if they have the necessary clearances, Bhati referred to the 7 permissions which were taken.The project will take 2 years and is likely to benefit only a particular section of society, and it is coming up without any public hearing, the petitioner’s counsel argued. The project goes “10 acres into the sea” and is not a “standalone jetty”, the counsel said. MMB said the project is 650m. The CJI remarked orally that such jetties are implemented globally. “If you go to Miami, there are so many.”
