Bengaluru stampede: RCB executive questions selective arrest in case

Bengaluru: Counsel representing Nikhil Sosale, the marketing head of Royal Challengers Sports Private Limited, on Tuesday raised concerns over the alleged disparity in police action regarding the June 4 Chinnaswamy Stadium stampede incident, noting that suspended officers avoided arrest.Senior advocate Sandesh Chouta highlighted during his arguments in the Karnataka High Court that while Shamanth was arrested at 3am by Ashoknagar police, followed by Nikhil’s arrest, the suspended police officers and the former political advisor to the chief minister faced no such action. Referring to the Supreme Court judgments, he stated that even for offences carrying sentences exceeding seven years, the accused’s freedom should not be automatically restricted. During the proceedings, Sosale’s representative questioned the arrests of Shamanth, a freelancer, alongside two DNA Entertainment Networks Pvt Ltd officials, arguing their lack of connection to the incident. He noted the FIR mentioned only organisations, not individuals, while questioning the basis for arresting Nikhil Sosale and three DNA employees, including Sunil Mathew (vice president) and Kiran Kumar (operations manager).Hearing todayJustice SR Krishna Kumar adjourned the proceedings to Wednesday after the Advocate General requested time for response submissions. In a related development, Acting Chief Justice V Kameshwar Rao and Justice CM Joshi’s division bench granted the state govt until Thursday to submit their detailed response to the suo motu PIL in a sealed cover. The advocate general expressed apprehension that the judicial commission’s pending report could be influenced by the high court’s observations in the matter. He also added that he would not like to place certain things pertaining to the case in open court. The bench agreed to the extension request and asked him to submit the response in a sealed cover on the next date of hearing.
