Mumbai: Shariful Fakir, the Bangladeshi national who allegedly attacked actor Saif Ali Khan at his home in Jan, sought bail, claiming he was falsely implicated and that the FIR was merely an imaginary account by the complainant, a staff nurse employed at the residence. Fakir was arrested on Jan 19, three days after the attack. “The charges sought to be attributed to the applicant are totally baseless and false, and he is falsely implicated. This is an incident of misuse and abuse of legal provisions,” the plea stated.
The bail application is scheduled for hearing on Tuesday before the sessions court. The 19-page plea said that the FIR is patently false and a false case was registered against Fakir. “That all the necessary recovery and discovery was done and the investigation is practically completed and mere filing of chargesheet is pending,” the plea said.
The plea also said that Fakir co-operated with the investigations. “Therefore, no useful purpose will be served by detaining him further in custody, save and except pre-trial punishment,” the plea said. The plea further stated that the prosecution collected all critical evidence, including CCTV footage and the call records, which were already in their possession. “The applicant does not pose any threat of tampering with the evidence or influencing witnesses,” the plea said.
In Jan, Mumbai Police confirmed that Shariful Islam’s face matched the image captured in CCTV footage from Khan’s residence. Officers conducted a facial recognition test after concerns were raised that Fakir’s appearance differed from the intruder seen in the footage. It was alleged that on December 31, Shariful surveyed the Bandra and Khar areas before securing a job at a Bandra (W) hotel, located just a few metres from Satguru Sharan, where Saif Ali Khan resides. Following a dispute with the hotel owner, he quit the job. On Jan 16, he allegedly walked from Bandra to Khar and then to Satguru Sharan, where he attempted a burglary, leading to the attack on the actor.
