Hyderabad: The Telangana high court has stayed the All India Council for Technical Education’s (AICTE) order barring the Sultan Ul Uloom Educational Society and the Muffakham Jah College of Engineering and Technology from admitting students.A division bench of acting Chief Justice Sujoy Paul and Justice Renuka Yara, however, clarified that any action taken or admissions given by the two institutions would be subject to the final outcome of the case.Both AICTE and institutions have been told to mention the condition on their websites.The court issued the directions while hearing an ongoing dispute over the land in Banjara Hills from where the institutions operate. The Sultan Society had been running the institutions from the land until AICTE barred them from admitting students. Some 1,500 students take admissions here every year. The institutions have been operating out of the property since 1980, but after some persons claimed ownership over the land, AICTE declined to give approvals in 2017.Subsequently, the society obtained an interim direction in its favour.In the present appeal, they claimed that the AICTE order had hampered the future of both the institutions and the students. “Approval cannot be declined mainly on the grounds that they do not have property documents, building plan, and occupancy certificate,” the society argued.In response, AICTE’s counsel contended that the society owning the land was a fundamental requirement without which approvals for admissions could not be granted.The bench, however, gave interim relief to the society on the grounds that the institutions have been running there since 1980 and an interim order had been prevailing since 2017.
