Bombay HC quashes FIR filed by air hostess against retired DCP  Madhukar Sankhe in Dadar parking dispute

MUMBAI: The Bombay High Court on Monday quashed an FIR filed against retired deputy commissioner of Police Madhukar Sankhe in connection with an alleged incident of misbehaviour during a parking-related dispute at a building in Dadar (East). The court held that the matter was purely personal and had been amicably resolved between the parties. A division bench comprising Justices Sarang V. Kotwal and S.M. Modak was hearing a petition seeking to quash the FIR registered at Matunga Police Station last year, under Section 79 of the Bharatiya Nyaya Sanhita, 2023, which deals with intentional insult intended to provoke a breach of peace. The complaint had been filed by an air hostess working for a private airline and a resident of Dadar. She alleged that during a dispute in August 2024, over a hoarding obstructing her parking space, Sankhe misbehaved with her and used derogatory language. However, during the hearing, the complainant informed the court through an affidavit that the dispute had arisen in the heat of the moment and was due to a misunderstanding. She stated that she no longer had any grievance against the accused and did not wish to pursue the case further. The complainant was personally present in court and confirmed the settlement. The court noted that both parties now resided in the same society and that continuation of the proceedings would serve no purpose. Accordingly, the court quashed the FIR and disposed of the petition.
