Mumbai: Bombay high court on Tuesday observed how Brihanmumbai Municipal Corporation (BMC) turned a blind eye, and Maharashtra State Electricity Distribution Company Ltd (MSEDCL) took no care or precaution in installation of a transformer in the middle of a road in Mulund, causing potential threat to human life. Justices Girish Kulkarni and Advait Sethna wondered how such an installation could even be done in the middle of the road, at the junction of Goregaon Mulund Link Road and LBS Road, Mulund (W). HC directed MSEDCL and BMC to take immediate steps to remove the “objectionable installation” by May 7.
“The municipal corporation appears to have turned a complete blind eye,” particularly when its work on the Goregaon Mulund Link Road is underway, HC observed. Its order stated that for any mishap in the monsoon this year, officials must be held responsible for all consequences, damages, and compensation required to be paid to any victim.

The high court order was in response to a petition filed by Marathon Maxima Co-op Housing Society, which, through its advocate Seema Chopda, submitted photos of the open transformer box and high-tension wires leading to it. The high court, perusing the photos, said that she rightly raised serious concerns about the safety hazard. “It certainly indicates imminent danger” that can arise, the high court observed.
The court had recently directed the state to inform what policy existed or could be framed to handle the issue of vehicles dumped outside a police station on the footpath and road, blocking pedestrians’ pathways. On Tuesday, Purnima Kantharia, govt pleader, sought more time to inform on the policy being framed.
The high court said that it, however, needs information on whether the vehicles are being removed and their count outside each police station in Mumbai, with photographs. The high court sought an affidavit from the state by May 7, when it will next hear the matter.
