Mumbai: Even as Bombay High Court reserved its order on whether a first information report (FIR) must be registered based on a magistrate’s inquiry report into the Sept 23, 2024, “encounter” death of Akshay Shinde, the accused in the Badlapur school sexual assault case, the state said the matter is being investigated in all its “dimensions”.
“Nothing else needs to be done in the matter. The state is discharging its duty in accordance with the law,” special public prosecutor Amit Desai told Justices Revati Mohite Dere and Neela Gokhale on Thursday.
The incident took place on Sept 23 while Shinde was being taken from Taloja jail on remand in another case.
The magistrate’s inquiry found the use of force was not justified and held five policemen responsible for Shinde’s death.
Desai said as an accidental death report (ADR) is registered, there is no need for an FIR. He said the state CID, after completing its investigation, will submit a report to the magistrate.
Desai also said the Supreme Court’s 2014 guidelines related to custodial deaths are being complied with. He reiterated his earlier submission that the magistrate’s report is not binding on the state. He said even Shinde’s parents, in their Sept 24 complaint to police authorities, “essentially said please do a proper investigation in the matter.”tnn
