HC orders man to undergo potency test in divorce case

Cuttack: Orissa high court upheld the order of a family court directing a husband to appear before the medical board for a potency test. This was part of the proceedings in a case where the wife filed a divorce petition on the grounds of his alleged impotency.
The husband filed a petition seeking the HC’s intervention against the family court (Khurda)’s order, contending that there was no need to undergo any further potency test. He argued that a doctor at AIIMS Bhubaneswar found him normal after examination.
However, upon examining the case records, the HC found that during cross-examination proceedings in the family court, the wife said the man was suffering from erectile dysfunction and had undergone treatment in Bhubaneswar.
Accordingly, the single judge bench of Justice Gourishankar Satapathy dismissed the husband’s petition as it was devoid of merit on Monday.
“In the circumstances, this court does not find any error apparent in the impugned order directing the petitioner-husband to undergo another round of potency test. This will clarify not only the court but also the parties about the issue involved in the matter, as the wife filed a divorce petition on the ground of impotency of the husband,” Justice Satapathy observed in Dec 9 order.
